In compliance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares, its Regulations and the Guidelines for the Privacy Notice, we inform you of the following:

Controller of Personal Data
K5 SERVICES, S.A. de C.V. (hereinafter “KeyPrediction”), with address at Prolongación Reforma 1190, Torre B, piso 21, Colonia Cruz Manca, Cuajimalpa de Morelos, C.P. 05349, Ciudad de México, and website http://www.keyprediction.com and telephone +52 (55) 5081-2070, is responsible for the use and processing of your personal data, which will be used solely for identification, operation, administration and other treatments necessary for the provision of services or the legal relationship you have with us, in compliance with the provisions of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP).
The privacy policies adopted by KeyPrediction aim to guarantee your right to decide freely and informedly about the processing of your personal data. This right is based on Article 16 of the Political Constitution of the United Mexican States, which recognizes the protection of personal data and the exercise of the rights of access, rectification, cancellation and opposition (ARCO), as provided by the LFPDPPP.
Purpose of the Processing of Personal Data
The personal data we collect will be processed by KeyPrediction for the following purposes, grouped according to their nature:

Primary purposes (necessary for the legal relationship):
● Provide the services you request or contract with K5, directly or through your representatives.
● Enter into service provision contracts, collaboration agreements or other related legal acts.
● Issue invoices, tax receipts and carry out administrative procedures related to payments, collections or refunds.
● Create, maintain and update your internal file as a client, supplier, employee or contractual counterparty.
● Comply with legal, fiscal, contractual or commercial obligations arising from the established legal relationship.
● Collect legal documentation that proves the legal personality and legal representation of legal entities, including powers of attorney, identifications and tax certificates.
● Respond to requests from competent authorities in compliance with legal obligations.

Secondary purposes (not essential, but that support business development):
● Carry out marketing initiatives, institutional communications, sending newsletters or event invitations.
● Promote and market technological products and services developed or distributed by K5.
● Provide after-sales services, technical support, responses to questions or clarifications, and service quality follow-up.
● Prepare internal reports, metrics and analyses for process improvement and strategic decision-making.
● Comply with contractual instructions from our clients regarding the handling of contact or administrative data of their representatives, within the scope of service provision.

If you do not wish your data to be processed for the secondary purposes mentioned, you may expressly state so at the time of its submission or at any later time by following the procedure indicated in the means to exercise ARCO rights.

KeyPrediction Services
KeyPrediction is an IT service provider focused on solutions such as Cognitive Computing, Artificial Intelligence, Big Data, Information Security, Software and Network Infrastructure, and Process Management. Our clients integrate these solutions into their operations through software applications and proprietary platforms.
Transfer of Personal Data
Your personal data will not be transferred to third parties or affiliates, except when necessary for our legitimate professional and business needs as required or permitted by the LFPDPPP.
If it becomes necessary to share your information with third parties to fulfill contractual obligations or for purposes compatible with those indicated in this Notice, transfers will be made under the highest standards of security and confidentiality and in accordance with applicable regulations. Exceptional cases in which your information could be transferred are the following:

● To competent authorities to respond to requests from courts, tribunals, government agencies or law enforcement.
● To companies within the same corporate group, subsidiaries, affiliates or parent companies, to which the same privacy policies apply.
● To clients, prospects, suppliers or third parties with whom there is a contractual or commercial relationship, limited to the purposes indicated in this notice.

All transfers will be carried out in accordance with Articles 35 and 36 of the LFPDPPP.
KeyPrediction may transfer data to third parties only for the fulfillment of its purposes and always under the principles of confidentiality, security and legality. Third parties will assume the same data protection obligations. Please note that some messages or data may be encrypted in transit and subject to secure monitoring.
Your consent will not be necessary for those transfers permitted in Article 37 of the LFPDPPP.
Likewise, you authorize KeyPrediction to use and transmit your personal information to improve service quality and for other compatible purposes in accordance with the law. If you do not wish your data to be processed for secondary purposes, you may indicate so by sending an email to legal@keyprediction.com.

Means to Exercise Your ARCO Rights
You have the right to:
● Access your personal data.
● Rectify them if they are inaccurate or incomplete.
● Cancel them when they are unnecessary or the relationship has ended.
● Object to their processing for specific purposes.
Personal data will be treated with strict confidentiality and protected with reasonable physical, administrative and technical measures. To exercise ARCO Rights, the data subject or their representative may send their request to legal@keyprediction.com accompanied by:
● Full name of the data subject.
● Address or any contact means.
● Official identification or power of attorney if acting as a legal representative.
● Clear description of the personal data in question and the right you wish to exercise.
● Any document that facilitates locating the information.

A response will be issued within a maximum of 20 business days as provided by the LFPDPPP.

Revocation of Consent
You may revoke at any time the consent granted for the processing of your data by sending your request to the email indicated in the previous section, except when consent was granted for other purposes and conditions in a separate document.
Processing of Personal Data through Artificial Intelligence
If KeyPrediction uses artificial intelligence (AI) technologies and automated algorithms to support processes related to the processing of your personal data, such as profiling, candidate evaluation, segmentation, personalized attention and service improvement, the following is informed:
● These tools are used for optimization and operational improvement.
● Automated decisions that significantly affect individuals are not made without human review.
● In case there are relevant automated decisions, efforts will be made to inform the data subjects and provide channels for clarifications or reviews.
